The terms "we", "us", "our", and "CBCTST" refer to PathOlOgics, LLC, Cairo, Egypt and any of their direct and indirect subsidiaries. PathOlOgics, LLC, Cairo, Egypt provides online, fully automated, and validated Clinical Decision Support (CDS) systems. These CDS systems automatically generate validated comprehensive clinico-pathologic correlations, which constitute clinical-grade diagnostic and prognostic narrative outputs.
The online Platform https://cbctst.com/Automated/Diagnosis has undergone rigorous validation by 51 international professors, consultants, and specialists from multiple medical centers across the USA, UK, Spain, UAE, KSA, and Egypt. This extensive validation confirmed full medical and clerical accuracy, anchored to hematopathology textbooks, the World Health Organization (WHO) 5th Edition updates, and other esteemed peer-reviewed publications.
The term "Platform" or "Website" refers to https://cbctst.com and any associated website pages or mobile applications available on the Apple App Store and Google Play Store. The information you enter as input for use of our validated Platform are collectively referred to as "User Content". Please DO NOT use this Platform or any of the Services, if you do not agree to these Terms.
Usage and HIPAA Compliance Notes
- NO personal information about the patient or the physician is required nor collected to use the Services. The Platform works with NO data (partial or complete) about: names, affiliations, positions, professions, emails, contacts, locations, user experience, purpose of use, nationality, or any other data that might be useful in personal, psychological, or usage identification. This is consistent with Health Insurance Portability and Accountability Act (HIPAA) regulations in the USA.
- The Website operates entirely ON-THE-FLY, analyzing the User Content and delivering accurate Services without storing any data. We do NOT track, store, use, publish, reproduce, modify, or distribute any user information or User Contents.
- There is NO capability within the Website to ascertain whether the Services are being used on real patients, simulated cases, academic activities, workshops, examination preparation, or research exercises.
- For technical data (e.g., device-level IP addresses),we don NOT see or store them. However, our hosting infrastructure provider, Microsoft Azure, automatically processes connection data (including IP addresses) solely for security purposes, such as firewall protection, DDoS mitigation, and service integrity. This processing is performed strictly within the Microsoft Azure environment under a signed HIPAA Business Associate Agreement (BAA). No technical data or IP addresses are shared with, sold to, or processed by any third-party cloud services outside of our secure Azure hosting enclave.
- The only data types permitted as input are numerical values entered for quantitative parameters, and selections of the most appropriate options from dropdown menus or checkboxes for qualitative parameters. In addition, the date of birth may be requested solely to determine the appropriate reference ranges for laboratory test results. NO text, images, audio recordings, or any other forms of data can be submitted to the Platform.
- You have to review any automatically generated Services in the context of the inputs you entered. The generated Services are validated to be accurate and complete for the corresponding User Content, and include a concise summary of your inputs. Once generated, you are responsible for copying and saving the output locally.
- Use of the Services for commercial activity is prohibited unless a commercial agreement has been formally issued and signed by Dr. Ahmed Elsafty, CEO of PathOlOgics, LLC, Cairo, Egypt. The same applies to commercial use of associated published papers and data.
- Getting a valid commercial agreement unlocks more Services and enables the usage of our interface software/ plugin that connects our Platform via a secure API to any Lab Information Systems (LIS) or Electronic Health Record (EHR) for automated User Content collection and Services delivery, with or without local technical integration. It also enables the creation of fully customizable model clones that are 100% controllable, updatable, and adjustable in both report style and content.
Your Data Rights
Since our Platform operates ON-THE-FLY without storing User Content or generated Services, we cannot provide access to, correct, or delete specific historical data. You are responsible for saving and controlling the Services output locally at your side.
Changes to These Terms
We may update these Terms and Privacy, but there will be a notification at the Platform, in case of major changes. The "Last Updated" date reflects the most recent changes. Continued use of the Platform after updates constitutes your acceptance.
Website Content
All clinical tools and materials available on or through the Website including text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, videos, images, applications, software, and all other content (collectively, the "Website Content"), as well as the design, layout, background colors, arrangement, and overall look and feel are the exclusive property of CBCTST or its licensors, and are protected by copyright, trademark, and other applicable intellectual property and unfair-competition laws.
You are NOT permitted to copy, reproduce, publish, distribute, store, transmit, display, modify, translate, adapt, create derivative works from, sell, rent, or license any portion of the Website Content, products, or Services, in any medium, except where expressly authorized in these Terms and Conditions. Without limitation, you may NOT use the Services to generate outputs in bulk, download aggregated outputs, or use any Website Content to develop or train artificial intelligence (AI) or machine learning (ML) systems.
You may NOT reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software used to provide the Website Content, except where explicitly permitted by applicable law and only with our prior written consent. You are further prohibited from performing systematic collection or harvesting of Website Content to create or assemble any dataset, compilation, database, or directory without prior written authorization.
Prohibited Activities
Any use of the Services beyond what is permitted by these Terms is strictly prohibited. Without limiting the foregoing, you are prohibited from using the Services in any of the following ways:
- To encourage or assist others in harming the Services or using the Services to harm others;
- To damage, disable, overburden, or impair the Services (or any network connected to the Services);
- To upload files that contain viruses or other malicious code that may cause damage to the property of CBCTST or the property of other individuals;
- To modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance, or in any way exploit any of the Services;
- Unless expressly authorized by us, you may not use any robots, spiders, crawlers, or other automated downloading programs, algorithms or devices, or any similar or equivalent manual process, to: (i) automatically search, scrape, extract, deep link, or index any content; (ii) harvest contact information from the Services for the purpose of sending unsolicited or unauthorized material; or (iii) cause disruption to the Services or any other person's use of the Services.
- To gain unauthorized access to any portion or feature of the Services, any other systems or networks connected to the Services, any CBCTST server, or any products or services provided on, accessed from, or distributed through the Services;
- To probe, scan, or test the vulnerability of the Services or any network connected to the Website, or to breach the security or authentication measures on the Services or any connected network;
- To impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity;
- To modify, publicly display, publicly perform, reproduce, or distribute any part of this Website;
- To violate any applicable local, state, national, or international law, statute, regulation, rule, order, or treaty;
- To cause CBCTST to violate any law or to distribute any malware or malicious content;
- To violate or infringe upon the intellectual property, privacy, or publicity rights of any person or entity;
- To post or transmit any unauthorized material to the Services, including, but not limited to, material that is, in our sole opinion, libelous, defamatory, obscene, threatening, pornographic, profane, racist, likely to cause annoyance, detrimental to or in violation of CBCTST's or any third party's systems or network security, or is otherwise unlawful;
- To defame or libel CBCTST, its employees, or other individuals, or to act in a way that brings the good name of CBCTST into disrepute; or
- To otherwise attempt to interfere with the proper working of the Website and the Services.
- If you violate these Terms and that violation results in a third-party claim against us, you agree to hire attorneys to defend us and to pay any damages we are required to pay as a result. You are solely responsible for any violation of these Terms by you. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such a case, you agree to cooperate with our defense of the claim.
Disclaimer of Warranties and Liability
- We provide the Services and all content "as is." This means we make NO promises and give NO guarantees about them EXCEPT for those with commercial agreements.
- We do NOT guarantee the suitability of any content, product, or service available through the Services EXCEPT for those with commercial agreements.
- To the fullest extent permitted by law, we disclaim all warranties, both express and implied EXCEPT for those with commercial agreements.
- You use the Services and their content entirely at your own risk. You should use the Services in light of your inputs and with full respect to the regulations at your organization.
- Important Notice for Healthcare Providers: You must use your own independent professional judgment to review the generated Services.
- We are NOT responsible for any injury or damage to persons or property resulting from the use of the Services or any information, procedure, or product contained within them.
- To the extent permitted by law, we will NOT be liable for any damages, including but not limited to indirect, special, incidental, or consequential damages, personal injury, loss of profits, data loss, or business interruption.
- We may display or link to third-party content, but we do not endorse, own, or take responsibility for any products, information, or services provided by others.
Indemnification
If you violate these Terms and it causes a third party to sue or make a claim against us, you agree to protect us from that claim. This means you will cover all our losses, damages, and costs, including reasonable legal fees. We have the right to take full control of the legal defense of any claim that you are required to cover. If we take control, you agree to cooperate fully with our defense. We will make a reasonable effort to notify you of any such claim.
